General Conditions of the Service

(pursuant to Chapter I, title 3, part 3, of Legislative Decree 206/2005 and subsequent amendments and additions)

1. Introduction and effectiveness of the General Conditions

These general conditions of sale (hereinafter, “General Conditions”) have as their object the regulation of the purchase of products made remotely and made available, via the Internet, from the website www.tartuber.it (hereinafter, the “Website“) In compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the” Consumer Code “).

The consumer who accesses the Website to make purchases (hereinafter “Customer“) is required, before sending the order, to carefully read these General Conditions which have been made available to him on the Website and which will be available at any time. by the Customer also through the link contained in the confirmation email of each order to allow it to be reproduced and stored.

In the event that the person making purchases on the Website requests an invoice and/or is not a “consumer or user” as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the withdrawal regulations pursuant to art. 7 and 8 of these General Conditions nor, more generally, the provisions that pursuant to the same Consumer Code apply only to “consumers”.

Contracts concluded with Tartuber SRL through the Website are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian or English.

2. Choose and order the Products

The characteristics and the price of the various products for sale on the Website (hereinafter “Product” or “Products“) are shown on the page relating to each Product.

To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained on the Website. The Customer must add the Product to the “Cart” and, after having read the General Conditions and the Policy of Privacy and confirmed their acceptance, must enter the shipping and billing data, select the desired payment method and confirm the order.

By sending the order from the Website, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided to him during the purchase procedure and to fully accept these transcribed General and Payment Conditions.

The contract stipulated between Tartuber SRL and the Customer must be considered concluded with the acceptance of the order by Tartuber SRL. This acceptance is communicated to the Customer through an order confirmation email containing a reference to these General Conditions, the order number, the shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including delivery costs. The Customer will check the confirmation email and if he identifies errors in the order he will have 12 hours from receiving this email to contact Customer Service directly from the Website using the appropriate contact form accessible via the “Contacts” tab. After this deadline, the order will be processed for shipment and changes will no longer be accepted, without prejudice to the rights of the Customer referred to in Article 7 below.

Once the order has been received, Tartuber SRL will check the availability of stocks for the fulfillment of the order. In the event that one or more Products are not available, the Customer Service will promptly send an email to the Customer who, within the next 12 hours, will have the right to reply to confirm the shipment of any additional Products available or cancel it. In case of no response within this period, the order will be considered confirmed and the available Products will be shipped. In this case, the entire amount relating to the missing Products will be canceled or in any case, depending on the payment method chosen, will not be charged to the Customer.

3. Product Information

The information and characteristics relating to the Products are available, with the relative Product codes, on the Website.

The visual representation of the Products on the Website, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be fully representative of its characteristics and quality but may differ in color and size. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.

4. Prices and shipping

Product prices are inclusive of all taxes and duties. All prices are expressed in Euros. The price of fresh products is often subject to unpredictable variations and the user may notice upward or downward fluctuations. Also for this reason reservations are not accepted, they would not allow us to establish the price to be paid in advance. The cost of shipments varies according to the total weight of the products purchased and the final destination of the delivery. On the Cart page, and subsequently in the Checkout page, the user can view the actual cost of the shipment (also specifying the place of destination of the goods) before proceeding to confirm the order.

Deliveries are made throughout the EU.

  • Shipping to Italy:

Shipments within the Italian territory are made by GLS Express Courier.

  • Shipments abroad:

Shipments outside Italy, but within the EU, are made by DHL Express Courier.

5. Methods of payment and invoicing

5.1 Payment methods

The Customer may pay the price of the Products and the related delivery costs by PayPal, bank transfer and cash on delivery.

  • PayPal/Credit Card

Once the order has been confirmed, the Customer can pay directly with his Paypal account or use a credit card, even prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relevant conditions.

  • Bank transfer

The Customer must make the transfer within 3 days from the order date for orders relating to products and within 1 day from the order date for orders containing events and/or courses. If this does not occur, the order will be canceled and the goods made available again for purchase by other customers. The Customer who has not made the transfer may be contacted by Customer Service in order to clarify whether the cause of the non-credit is due to the Customer’s will not to confirm the purchase or to other causes.

Reason: the Customer must indicate the date and order number in the reason for the transfer, which can be found in the confirmation email (eg “Order 01/01/14 n. 100012345”).

  • Cash on delivery

This payment method is available only for shipments made in Italy and only for orders not exceeding € 500.00. Payment will be made upon receipt of the Products and can only be made in cash. For cash on delivery shipments, the customer is required to pay a shipping fee of € 3.00 + 3% of the total cost.

5.2 Invoicing of orders

If the purchase is made by a professional, it will be possible to request an invoice by selecting the appropriate box during the order procedure and entering the billing information including tax code and/or VAT number. In this case, the invoice will be sent by email to the address indicated. The professional is responsible for the proper entry of billing data and is expressly informed that, in case of failure to request the invoice during the order, it will not be possible to request it later.

6. Transport and delivery

The Products purchased on the Website will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate “Shipping Data” field.

All purchases will be delivered by express courier (hereinafter, “Courier“) from Monday to Friday, excluding holidays and national holidays. Tartuber SRL is not responsible for unforeseeable delays or those not attributable to it.

Once the Products have been shipped, the Customer will receive a confirmation email which will include a link to refer to for tracking the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within a period of 3 (three) working days starting from the day following the one in which Tartuber SRL confirmed the order to the Customer by means of a specific order confirmation email.

7. Right of withdrawal

The Customer has the right to withdraw from the contract as established by Legislative Decree no.21 of 21 February 2014.

To exercise the right of withdrawal, the Customer is required to follow what is expressed on the page of this site dedicated to the Right of Withdrawal.

8. Errors and Limitations of liability

The information relating to the Products provided through the Website is constantly updated. However, it is not possible to guarantee the complete absence of errors for which Tartuber SRL cannot therefore be held responsible, except in the case of willful misconduct or gross negligence.

Tartuber SRL reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to change or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Conditions and the Consumer Code.

Except for willful misconduct or gross negligence, any right of the Customer to compensation for damages or the recognition of compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance or evasion, even partial, of an order.

Tartuber SRL promotes the responsible consumption of alcohol and excludes any liability at its own expense, except for willful misconduct or gross negligence, in the case of a purchase made by children under 16.

9. Applicable law and competent court

The sales contract between the Customer and Tartuber SRL is concluded in Italy and governed by Italian law. For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, the court of his/her town of residence or of domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Spoleto, any other competent court excluded.

Pursuant to Article 1341 of the Italian Civil Code the Customer declares to have read and specifically accepted the following articles of these General Conditions: 6 (responsibility for delays in delivery), 8 (right to correct errors – disclaimers).

Shipping and Delivery

Packages are sent via GLS for Italy and UPS for abroad. In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within a period of 3 (three) working days starting from the day following the one in which Tartuber SRL confirmed the order to the Customer by means of a specific order confirmation email.

Shipping is free for orders over €89 with delivery in Italy.

Whichever type of shipment you choose, we will guarantee you a link to track your package’s path online.

Shipping costs include packaging and postage costs. Packaging costs are fixed, while transport costs vary according to the total weight of the shipment.

We recommend that you group your items in one order. We cannot group two distinct orders placed separately, and shipping costs will be applied to each of them. Your package will be sent under your responsibility, but special attention is paid to fragile items.

The boxes are reasonably sized and your items are well protected.

In the case of the purchase of frozen products, a surcharge of €24 will be applied to the shipping costs for every 10Kg of product purchased. This is the cost of setting up a refrigerated shipment.

In the case of cash on delivery, the additional € 5.00 + 3% of the total amount of the cart will be charged to the cart, charged to the management costs of the cash on delivery (required by the Courier)

Right of withdrawal

(pursuant to art. 49, paragraph 4, legislative decree 21/2014)

You have the right to withdraw from the contract, without giving any reason, within 14 days.

The withdrawal period expires after 14 days from the day on which you or third-party, other than the carrier and designated by you acquire physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from the purchase order by means of an explicit declaration to be sent within the aforementioned deadline by registered letter with return receipt to the following address:

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

To this end, you can use the attached withdrawal form, or any other type of explicit written declaration of your intention to withdraw from the order, as long as it is sent to the address indicated above with the forms and within the terms mentioned above.

In the event of exclusion of the right of withdrawal, Tartuber SRL will return the purchased products to you, charging you the return shipping costs.

Effects of Withdrawal

If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of the additional costs arising from your choice of a type of delivery other than the least expensive type of standard delivery to offered us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, it will not incur any costs as a consequence of this reimbursement.

Exceptions

You are only responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:

  • order of Products made to measure or clearly personalized;
  • order of Products that are likely to deteriorate or expire rapidly;
  • order of sealed Products that cannot be returned for hygienic reasons or related to health protection or that have been opened after delivery.
